ROW 1 Terms and Conditions

Welcome to ROW 1. These Terms and Conditions (“Terms”) govern your access to and use of the ROW 1 mobile application, website, and related services (collectively, the “Services”).

By creating an account, accessing, or using ROW 1, you agree to be bound by these Terms, our Privacy Policy, applicable Official Rules for individual promotions, and any other rules or policies posted by ROW 1.

If you do not agree to these Terms, you may not use the Services.

 

1. About ROW 1

ROW 1 is a digital platform that provides users with access to giveaways, sweepstakes, promotions, prizes, products, and related experiences.

ROW 1 may offer different promotions from time to time. Each promotion may have its own Official Rules containing specific information regarding eligibility, entry methods, deadlines, prizes, odds, winner selection, and other requirements.

Where promotion-specific Official Rules conflict with these Terms, the applicable Official Rules will control with respect to that specific promotion.

 

2. Eligibility

You must meet all eligibility requirements applicable to the ROW 1 Services and any individual promotion in which you participate.

Certain promotions may be restricted by:

  • Age;

  • Geographic location;

  • Residency;

  • Applicable federal, state, or local law;

  • Promotion-specific eligibility requirements; or

  • Other requirements stated in the applicable Official Rules.

You are responsible for determining whether you are eligible to participate.

ROW 1 reserves the right to verify eligibility at any time.

ROW 1 may require proof of identity, age, residency, or other eligibility information before allowing participation or awarding a prize.

 

3. Account Registration

Certain ROW 1 features may require you to create an account.

When creating an account, you agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring through your account.

You agree not to:

  • Create an account using false information;

  • Create accounts for another person without authorization;

  • Create multiple accounts for the purpose of obtaining additional entries or advantages;

  • Share your account credentials;

  • Sell, transfer, or assign your account;

  • Impersonate another person; or

  • Use another person's account without permission.

ROW 1 may suspend or terminate accounts that violate these Terms.

 

4. Sweepstakes and Giveaways

ROW 1 may conduct sweepstakes, giveaways, contests, and other promotional events.

Each promotion may have separate Official Rules.

The applicable Official Rules may specify:

  • Promotion start and end dates;

  • Eligibility requirements;

  • Available methods of entry;

  • Number of entries permitted;

  • Prize descriptions and values;

  • Winner selection procedures;

  • Odds of winning;

  • Winner notification procedures;

  • Prize fulfillment requirements;

  • Geographic restrictions; and

  • Any applicable free alternative method of entry.

No purchase is necessary to enter or win a sweepstakes where required by applicable law.

Purchasing a product, entry, or other item does not guarantee that you will win a prize.

Odds of winning depend on the number of eligible entries received and the applicable winner-selection process.

 

5. Entries

Where a promotion permits entries to be obtained through a purchase or other qualifying activity, entries will be credited to the eligible account associated with the transaction or activity.

Entries may not be:

  • Sold;

  • Transferred;

  • Traded;

  • Bartered;

  • Assigned;

  • Duplicated;

  • Forged;

  • Manufactured through unauthorized methods; or

  • Obtained through fraudulent activity.

ROW 1 reserves the right to invalidate entries that we reasonably believe were obtained through fraud, abuse, manipulation, technical exploitation, or violation of the applicable Official Rules.

 

6. Alternative Methods of Entry

Where required by applicable law, a promotion may provide a free alternative method of entry (“AMOE”).

The specific requirements for any AMOE will be stated in the applicable Official Rules.

An AMOE, when offered, will provide an eligible participant with an opportunity to enter without making a purchase, subject to the applicable rules and entry limitations.

 

7. Purchases and Payments

ROW 1 may offer products, services, promotional entries, or other items for purchase.

Prices will be displayed before you complete a transaction.

By submitting a purchase, you authorize the applicable payment processor to process the transaction using the payment method you provide.

Payment processing may be handled by third-party payment providers.

ROW 1 may not have access to your complete payment card or bank account information.

You agree to provide accurate billing and payment information.

ROW 1 reserves the right to refuse, cancel, or limit transactions where permitted by law, including transactions that appear fraudulent, unauthorized, abusive, or otherwise inconsistent with these Terms.

 

8. Refunds and Cancellations

Except where otherwise required by applicable law or expressly stated in the applicable promotion or purchase terms, purchases and promotional entries may be non-refundable once processed or once an entry has been credited.

If a transaction was made in error, was unauthorized, or is otherwise eligible for a refund under applicable law, you may contact ROW 1 customer support.

ROW 1 reserves the right to investigate refund requests before issuing a refund.

Refunds, when approved, may be returned to the original payment method where reasonably possible.

 

9. Prizes

Prizes will be described in the applicable promotion's Official Rules.

ROW 1 may substitute a prize with another prize of equal or greater approximate retail value when circumstances outside of ROW 1's reasonable control make the originally advertised prize unavailable, subject to applicable law.

Prizes are generally non-transferable and cannot be exchanged for cash unless expressly stated otherwise.

The actual appearance, model, color, specifications, or availability of a physical prize may vary from promotional images.

ROW 1 does not guarantee that a prize will be identical to promotional photography.

 

10. Winner Selection and Verification

Potential winners will be selected according to the method described in the applicable Official Rules.

A potential winner may be required to complete a verification process before being declared an official winner.

This may include providing:

  • Legal name;

  • Date of birth;

  • Proof of identity;

  • Proof of residency;

  • Mailing address;

  • Tax information;

  • Eligibility documentation; or

  • Other information reasonably necessary to verify eligibility and fulfill the prize.

Failure to respond within the required period, provide requested documentation, satisfy eligibility requirements, or comply with the applicable Official Rules may result in disqualification and selection of an alternate potential winner where permitted.

 

11. Taxes and Prize-Related Expenses

Winners are responsible for any federal, state, local, or other taxes associated with receiving or accepting a prize, except where applicable law requires ROW 1 or another party to handle such taxes.

ROW 1 may request tax information from winners when required for reporting or compliance purposes.

Unless otherwise stated in the applicable Official Rules, winners are responsible for expenses associated with accepting or using a prize.

 

12. Winner Publicity

Where permitted by law, ROW 1 may use a winner's name, city/state, likeness, photograph, or other publicly available information for promotional purposes without additional compensation.

Certain promotions may require winners to sign a publicity release.

If applicable law prohibits ROW 1 from using your information for promotional purposes without additional consent, ROW 1 

will comply with applicable law.

 

13. Prohibited Conduct

You agree not to use ROW 1 to:

  • Violate any applicable law or regulation;

  • Commit fraud;

  • Manipulate entries or winner-selection systems;

  • Use bots, scripts, automated software, or unauthorized technology;

  • Exploit technical vulnerabilities;

  • Circumvent entry limits;

  • Create fraudulent accounts;

  • Use stolen payment information;

  • Interfere with another user's account;

  • Attempt to gain unauthorized access to ROW 1 systems;

  • Reverse engineer or decompile the application;

  • Upload malicious software;

  • Impersonate another individual or business;

  • Harass ROW 1 employees, contractors, partners, or other users;

  • Submit false information;

  • Abuse promotions or referral programs;

  • Engage in activity designed to artificially increase entries or rewards; or

  • Otherwise interfere with the operation or integrity of ROW 1.

 

14. Fraud and Account Security

ROW 1 takes fraud and promotional manipulation seriously.

We may monitor transactions, accounts, entries, devices, IP addresses, payment activity, and other information for purposes of detecting suspicious or unauthorized activity.

If we reasonably believe that an account or transaction is associated with fraud, abuse, manipulation, or a violation of these Terms, we may:

  • Suspend the account;

  • Cancel transactions;

  • Void entries;

  • Withhold prizes;

  • Restrict access to promotions;

  • Request additional verification;

  • Cancel rewards; or

  • Terminate the account.

Nothing in this section limits any other rights or remedies available to ROW 1 under applicable law.

 

15. Multiple Accounts

Unless expressly permitted by the applicable Official Rules, each person may maintain only one ROW 1 account.

Creating multiple accounts to obtain additional entries, promotions, bonuses, rewards, or other benefits is prohibited.

ROW 1 may identify and deactivate duplicate or fraudulent accounts.

Entries or rewards associated with prohibited accounts may be voided.

 

16. Intellectual Property

The ROW 1 application, website, branding, logos, graphics, text, designs, software, photographs, videos, content, and other materials provided by ROW 1 are owned by or licensed to ROW 1 and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, license, publicly display, reverse engineer, or otherwise exploit ROW 1 intellectual property without prior written permission.

ROW 1 and the ROW 1 name, logos, designs, and related branding are trademarks or intellectual property of ROW 1 or its respective owners.

 

17. User-Submitted Content

Certain ROW 1 features may allow you to submit photographs, videos, reviews, comments, profile information, messages, or other content (“User Content”).

You retain ownership of User Content that you own.

By submitting User Content to ROW 1, you grant ROW 1 a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, modify as reasonably necessary for technical purposes, and otherwise use the content as necessary to provide and promote the Services, subject to applicable law and our Privacy Policy.

You represent that you have the necessary rights and permissions to submit the User Content.

You may not submit content that:

  • Violates another person's rights;

  • Contains unlawful material;

  • Infringes intellectual property rights;

  • Contains malicious software;

  • Is fraudulent or deceptive;

  • Harasses or threatens others; or

  • Violates these Terms or applicable law.

 

18. Third-Party Services

ROW 1 may rely on third-party companies and services for payment processing, hosting, analytics, communications, advertising, authentication, fraud prevention, shipping, customer support, and other functions.

Third-party services may have their own terms and privacy policies.

ROW 1 is not responsible for the independent actions, policies, or practices of third-party services.

 

19. Communications

By creating a ROW 1 account or providing your contact information, you may receive communications relating to your account, transactions, promotions, security, customer support, and other Services.

Where required by law, promotional text messages or emails will be sent only with appropriate consent.

You may opt out of promotional communications using the instructions provided in those communications.

You may continue to receive important transactional or account-related communications.

20. Privacy

Your use of ROW 1 is also governed by the ROW 1 Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

The ROW 1 Privacy Policy is incorporated into these Terms by reference.

 

21. Availability of the Services

We attempt to keep ROW 1 available and operational, but we do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

ROW 1 may temporarily suspend or modify the Services for:

  • Maintenance;

  • Updates;

  • Security concerns;

  • Technical issues;

  • System failures;

  • Third-party service interruptions;

  • Legal requirements; or

  • Other circumstances beyond our reasonable control.

 

22. Changes to ROW 1

We may modify, suspend, discontinue, or replace any portion of the Services at any time.

We may add or remove features, promotions, products, entry methods, or other functionality.

Changes may be made without prior notice where permitted by law.

 

23. Account Suspension and Termination

We may suspend or terminate your account if:

  • You violate these Terms;

  • You violate applicable Official Rules;

  • You engage in fraudulent or abusive conduct;

  • Your account creates a security risk;

  • Your activity may expose ROW 1 to legal liability; or

  • We are otherwise permitted or required to do so by applicable law.

You may stop using ROW 1 at any time.

Termination does not necessarily eliminate obligations or rights that arose before termination.

 

24. Disclaimers

To the maximum extent permitted by law, ROW 1 provides the Services on an “as is” and “as available” basis.

ROW 1 does not guarantee that:

  • The Services will always be available;

  • The Services will be error-free;

  • Promotions will always be available;

  • Information displayed through the Services will always be complete or accurate;

  • Your account will never experience unauthorized access; or

  • You will win any sweepstakes, giveaway, contest, or promotion.

Nothing in these Terms excludes warranties or protections that cannot legally be excluded under applicable law.

 

25. Limitation of Liability

To the maximum extent permitted by applicable law, ROW 1 and its owners, officers, employees, contractors, affiliates, partners, service providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.

To the maximum extent permitted by law, ROW 1's total liability arising from your use of the Services will be limited to the greater of:

  1. The amount you paid to ROW 1 during the twelve months immediately preceding the event giving rise to the claim; or

  2. $100.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

 

26. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ROW 1 and its owners, officers, employees, contractors, affiliates, partners, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

  • Your violation of these Terms;

  • Your violation of applicable law;

  • Your misuse of the Services;

  • Your User Content;

  • Your fraudulent or unauthorized activity; or

  • Your violation of another person's rights.

 

27. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact ROW 1 and provide an opportunity to resolve the dispute informally.

Any dispute-resolution requirements applicable to a particular sweepstakes or promotion will be stated in the applicable Official Rules.

Where permitted by law, disputes may be subject to binding arbitration rather than litigation in court.

Nothing in this section prevents a party from seeking temporary or injunctive relief where legally permitted.

28. Governing Law

These Terms will be governed by the laws specified in the applicable jurisdiction selected by ROW 1, without regard to conflict-of-law principles, except where applicable law requires otherwise.

29. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

 

30. Entire Agreement

These Terms, together with the ROW 1 Privacy Policy, applicable Official Rules, and any other policies expressly incorporated into these Terms, constitute the agreement between you and ROW 1 regarding your use of the Services.

 

31. Changes to These Terms

ROW 1 may update these Terms from time to time.

When we update these Terms, we may change the “Last Updated” date at the top of the page.

For material changes, we may provide additional notice through the Services, email, or another appropriate method.

Your continued use of ROW 1 after updated Terms become effective constitutes acceptance of the updated Terms.
